Our terms of business
1. General information
Any additional terms that deviate from the conditions specified here and which are agreed by any representative or employee must be made in writing to be legally binding. The client waives any right to the enforcement of his or her own purchase conditions.
2. Confidentiality notice
The purchase of an instrument does not authorize the purchaser or his/her representative to obtain insights into our workshop secrets and methods. This applies in particular to the creation process, material compositions, methods and acoustic analyses. Insofar as the purchaser or his/her representative gains access to any workshop secrets during a visit, he/she is not authorized to provide this information in any form to third parties.
3. Delivery dates
We will use our best efforts to comply with promised delivery dates and will inform the client in case there is a delay. We consider a delay of a few weeks within reason and such delay should be acceptable to the customer.
4. Prices
All prices are ex works (Martin Schleske Master Studio for Violinmaking in Stockdorf, Germany) without value added tax (VAT). Completed instruments are generally delivered personally to the client in our studio.
5. Payment
A payment equal to 20% of the total price is due when the order is placed. This allows us to individually concentrate on client orders with the assurance that the order is binding. The remaining sum is either paid in cash when the completed instrument is hand-delivered or via wire transfer in advance.
6. Retention of ownership
The instrument remains our property without limitations until the price is paid in full.
7. Return option
Every instrument that is ordered comes with the right of return subject to the following conditions:
7.1. The return option is valid within two weeks after delivery of the instrument. The returned instrument may not be damaged or modified compared to the state in which it was originally delivered.
7.2 The client must inform the Martin Schleske Master Studio for Violinmaking in writing within this period if he or she wishes to invoke the return option.
7.3 The instrument must be returned at the facilities of the Martin Schleske Master Studio for Violinmaking.
The price paid (including the deposit) will be refunded after the instrument is returned. We will retain a handling fee in the amount of EUR 200.00 to compensate for touching up the varnish, changing strings, etc.
8. Packaging and shipping
Instruments will be shipped only at the receiver’s risk. We will deliver the instrument to the shipping location using commercially accepted packaging in the best possible manner available to us.
9. Place of fulfillment
The place of fulfillment is agreed to be the facilities of the Martin Schleske Master Studio for Violinmaking.
10. Export
10.1 For delivery to EU countries except for Germany, the following legal provisions apply as prerequisites for exemption from value added tax (“internal commercial export”):
1. The client must provide us with his or her sales tax ID number when placing the order.
2. The instrument will be exported to the country specified on the invoice (see address).
3. The instrument will be used commercially.
10.2 Delivery outside of the EU with an exemption from value added tax is possible after we receive the customs paperwork stamped by the export customs office. In this case, the client shall immediately provide the customs paperwork to us via mail after the instrument is exported.
